Skyhawk Flat Roofing - General Terms and Conditions

These Terms and Conditions (the "Agreement") govern the services provided by Skyhawk Flat Roofing ("we", "our", "us") to the customer ("you", "your"). By engaging our services, you agree to be bound by these Terms and Conditions.

1. Introduction

By using the services of Skyhawk Flat Roofing, you agree to the following terms. Please read this document carefully before engaging our services. If you do not agree to these terms, please do not engage our services.

2. Services Provided

Skyhawk Flat Roofing provides a range of roofing services, including but not limited to:

  • EPDM Rubber Roof Installation

  • Roof Inspections

  • Flat Roof Construction

  • Roof Repairs and Maintenance

  • Emergency Call-Out Services

  • Roof Cleaning (including removal of moss and debris)

  • Gutter Cleaning and Maintenance

  • Drone Roof Surveys

3. Payment Terms

  • Payment Upon Completion: A formal invoice will be provided immediately upon completion of the work on-site, unless otherwise agreed. Invoices are due immediately upon completion of the work unless specified in the contract.

  • Stage Payments: For larger or more complex projects, payments may be made in stages, depending on the size of the job. These payments will typically cover the cost of materials upfront. Each stage payment may be calculated as a percentage of the total project cost, based on materials and work completed. The specific breakdown will be agreed upon in the project estimate.

  • Pricing: All prices quoted are subject to change based on the specific needs of the project, property size, and location. Prices will be confirmed in writing before the commencement of any work.

  • Invoices: A formal invoice will be provided upon completion of services or as agreed. Payment is due within 14 days of receiving the invoice, unless otherwise agreed.

  • Late Payment: If payment is not received immediately after the completion of work, we reserve the right to charge a late payment fee of 2% per month on any overdue amounts.

  • Debt Recovery: In the event of non-payment, we reserve the right to refer the outstanding debt to a debt recovery agency, and you will be responsible for any additional fees incurred during this process.

4. Scope of Work

  • Estimates: Any estimates or quotes provided are based on the information available at the time. Should there be any changes or unforeseen issues during the course of the work, additional charges may apply. You will be notified of any changes to the original scope before proceeding.

  • Workmanship: All work carried out by Skyhawk Flat Roofing will be performed by qualified professionals with due care and attention. We guarantee the quality of our work for a period of 12 months from the completion of the service unless otherwise specified in the contract.

  • Permits and Licenses: It is the responsibility of the customer to ensure that all necessary permits and licenses are obtained for the work to be carried out unless otherwise agreed.

5. Customer Responsibilities

  • Access to Property: You are responsible for providing us with clear access to your property to perform the services. Any delays due to lack of access may incur additional charges.

  • Health and Safety: You must notify Skyhawk Flat Roofing of any known hazards or risks on your property that could affect the safety of our team during the project.

  • Preparation: For roofing projects, you are responsible for removing or securing personal belongings or items that may obstruct work areas or get damaged during the process.

  • Environmental Impact: We aim to carry out our services in an environmentally responsible manner, including the disposal of materials in compliance with local regulations.

6. Additional Guarantees for New Roofs

  • Roof Care Plan Requirement: Any additional guarantees offered for newly installed roofs are conditional upon the customer taking out our Roof Care Plan. This plan includes regular inspections, roof and gutter cleaning, and maintenance to ensure the longevity of your roof and its materials.

  • Annual Roof and Gutter Cleaning: If you do not wish to subscribe to our Roof Care Plan, you must at a minimum have your roof and gutters cleaned once per year. Failure to comply with this requirement may result in premature failure of the roof materials, as debris and moss buildup can damage the roof’s integrity over time.

7. Limitation of Liability

  • General Liability: Skyhawk Flat Roofing will not be held liable for any indirect, incidental, or consequential damages arising from our services. Our liability for any loss or damage will be limited to the total amount paid for the services rendered.

  • Force Majeure: We will not be liable for any delay or failure in performance of services caused by circumstances beyond our reasonable control, including, but not limited to, adverse weather conditions, natural disasters, or government action.

8. Termination of Services

  • By Skyhawk Flat Roofing: We reserve the right to terminate or suspend our services if you fail to comply with these Terms and Conditions or if we are unable to access the property or complete the work due to unforeseen circumstances.

  • By Customer: You may cancel any work order with 7 days' notice prior to the scheduled start date. Cancellations made after this period may incur a cancellation fee based on work already performed or materials purchased.

  • Outstanding Payments: If the service is terminated due to non-payment or breach of contract, the remaining balance for the work already performed will be due immediately.

9. Insurance

Skyhawk Flat Roofing maintains appropriate insurance to cover general liability, workers' compensation, and any other necessary insurance to ensure safe and responsible service delivery. Proof of insurance can be provided upon request.

10. Privacy and Data Protection

We are committed to protecting your privacy and handling your personal data in accordance with the General Data Protection Regulation (GDPR). We will only collect, process, and store your personal data for the purposes of providing the services you have requested.

11. Dispute Resolution

In the event of any disputes arising from our services, we encourage you to contact us directly to attempt to resolve the issue amicably. If we are unable to reach a resolution, the dispute will be governed by the laws of England and Wales, and any legal action will be taken in the courts of England.

12. Amendments

Skyhawk Flat Roofing reserves the right to amend these Terms and Conditions at any time. Any changes will be communicated to you in writing and will apply to new contracts or services initiated after the date of the amendment.

13. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising under these terms will be resolved in the courts of England.

Acceptance of Terms

By engaging Skyhawk Flat Roofing for your roofing needs, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
